Terms & Conditions of Hire

Contract: A contract shall exist between you (the client) and us (West Country Marquees Ltd) when the following conditions have been satisfied:

  • You have accepted our proposal in writing

  • We have received the required deposit

  • We have confirmed receipt of your acceptance & deposit in writing

Payment Terms: A deposit of 25% of the total order value is payable at the point of acceptance.  The balance must be paid 14 days before the commencement of hire.  If the contract is cancelled by you, the following charges will apply depending on the notice given prior to the commencement of hire:-

  • More than 28 days           – 25% of the total hire charge

  • 14 to 28 days                     – 70% of the total hire charge

  • Less than 14 days             – 100% of the total hire charge

Delay or failure to complete: West Country Marquees shall not be liable as a result of:

  • The site being unsuitable

  • The site being unavailable at the time of delivery

  • Adverse wind or weather conditions

  • Loss or damage to equipment by fire or flood

  • Any industrial dispute, lock out or strike

  • Any cause outwith our control

Delivery to Site: The time and date of delivery will be agreed prior to the commencement of hire, you must ensure:-

  • The site is available, in a suitable condition and has access for commercial vehicles

  • Your representative is present to check delivery and to confirm the siting of marquees & equipment

  • If no one is present you will be deemed to have accepted the delivery and our siting of the marquee and equipment, and, will liable for the cost of any changes

  • You will make us aware of any underground services or obstructions which could hinder or cause injury including the presence of electricity cables, gas & water pipes.

Equipment on Site: You are responsible for the safe custody of all equipment whilst on site:-

  • Maintain adequate heat to protect against frost, snow or ice damage

  • Firmly close all openings when not in use to prevent against wind damage

  • Suspend nothing from the marquees without our written consent

  • You must make good to us any loss or damage including cleaning costs when incurred

Insurance: With respect to clause 5 above, insurance cover in respect of storm, fire, theft and vandalism damage is required.  In the event of loss or damage to our equipment a maximum excess of £500.00 will be payable when a damage waiver has been included in the quotation.  If you opt against our damage waiver then we will require proof of your insurance policy that covers our marquees and associated equipment for the appropriate sums.

Liability: If we fail to fulfil any terms of this contract our liability is limited to refund or cancellation of the hire charge.  We shall not be liable for any indirect, special or consequential loss or damage. Any loss or damage caused by ourselves, our employees or agent shall not exceed the amount of the hire charges. This condition does not apply to death, personal injury caused by negligence or losses arising out of fraudulent misrepresentation by us. We shall not be liable for any loss or damage to property or equipment owned by you or in your care stored in our marquees.
